Terms of Service

Welcome to TapHorizon: Ascend. These Terms of Service ("Terms") govern your use of our mobile application ("App") operated by Hermes Horizon Pty Ltd ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using TapHorizon: Ascend, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. We reserve the right to terminate access for users who do not meet eligibility requirements.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes, subject to these Terms. This license does not include:
- Modifying, reverse engineering, or decompiling the App
- Using the App for commercial purposes
- Distributing or transferring the App to third parties
- Creating derivative works based on the App
4. User Accounts
If you create an account or link with Apple ID:
- You are responsible for maintaining account security
- You must provide accurate information
- You may not share your account with others
- You are responsible for all activity under your account
5. In-App Purchases
5.1 Virtual Items
The App offers virtual items for purchase, including but not limited to:
- Cosmetic skins
- Energy refills
- Ad removal
- Premium subscription
Virtual items have no real-world value and cannot be exchanged for cash or other items of value.
5.2 Subscriptions
Premium subscriptions are billed monthly through Apple. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your Apple ID settings.
5.3 Refunds
All purchases are processed by Apple and are subject to Apple's refund policy. We do not process refunds directly. For refund requests, contact Apple Support.
6. User Conduct
You agree not to:
- Use cheats, exploits, automation software, or any unauthorized third-party tools
- Interfere with or disrupt the App or servers
- Attempt to gain unauthorized access to other users' accounts
- Harass, abuse, or harm other users
- Violate any applicable laws or regulations
- Exploit bugs or glitches for unfair advantage
7. Intellectual Property
All content in the App, including but not limited to graphics, music, code, text, and game mechanics, is owned by Hermes Horizon Pty Ltd and protected by copyright and other intellectual property laws. TapHorizon and related marks are trademarks of Hermes Horizon Pty Ltd.
8. User-Generated Content
If you submit content through the App (such as usernames or high scores on leaderboards), you grant us a worldwide, royalty-free license to use, display, and distribute such content in connection with the App.
9. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYTAP GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE PAST 12 MONTHS.
11. Indemnification
You agree to indemnify and hold harmless Hermes Horizon Pty Ltd from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
12. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, you lose access to any virtual items or purchases associated with your account.
13. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. Material changes will be communicated through the App or by email.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
